The availability of services may vary depending on the healthcare provider, hospital, clinic, or medical scheme.
3. Eligibility
You may use the Application only if:
- You are at least 18 years of age; or
- You are the parent, legal guardian, or authorised representative of the patient; or
- You are legally authorised to act on behalf of another individual.
You confirm that all information provided during registration is accurate, complete, and current.
4. Registration and User Account
To access certain services, users must create an account.
You agree to:
- Register using accurate information.
- Maintain updated contact information.
- Keep your username, password, OTP, and authentication credentials confidential.
- Notify JSK Healthcare immediately if you suspect unauthorised access to your account.
You remain responsible for all activities performed through your account.

For patient safety and regulatory compliance, JSK Healthcare may verify your identity using one or more of the following:
- Mobile OTP
- Email Verification
- Identity Number
- Passport Number
- Medical Record Number (MRN)
- Biometric Authentication (where supported)
Failure to complete verification may limit access to certain services.
6. Acceptable Use
You agree to use the Application only for lawful purposes.
You must not:
- Provide false or misleading information.
- Impersonate another person.
- Share another person's medical information without authority.
- Attempt unauthorised access.
- Upload malicious software.
- Interfere with system security.
- Reverse engineer or modify the Application.
- Use automated tools to access the platform.
- Misuse prescriptions, medical certificates, or claims information.

The Application provides technology to support healthcare delivery.
Medical advice, diagnosis, prescriptions, referrals, laboratory requests, medical certificates, and treatment decisions are provided solely by authorised healthcare professionals.
JSK Healthcare does not replace professional medical judgement.

- Must not be altered or misused.
- May be verified by pharmacies, employers, insurers, or other authorised organisations where applicable.

Laboratory and radiology reports displayed within the Application are provided electronically for patient convenience.
Users should consult their treating healthcare professional for interpretation of any diagnostic results.

Where applicable, the Application may facilitate:

- Claims submission
- Claims reconciliation
- Electronic remittance advice
Claims processing remains subject to the rules and requirements of the relevant medical scheme, administrator, or healthcare funder.
14. Payments
Where payment functionality is available:
- Payments shall be processed through authorised payment providers.
- Users remain responsible for applicable consultation fees, hospital charges, pharmacy charges, laboratory charges, or other healthcare fees.
- Refunds are governed by the policies of the healthcare provider or payment service provider.

Your personal and health information is processed in accordance with applicable South African legislation, including the Protection of Personal Information Act (POPIA), and as described in the JSK Healthcare Patient Consent Form and Privacy Policy.

Where necessary and legally permitted, information may be shared with:
- Treating healthcare professionals.
- Hospitals and clinics.
- Laboratories and radiology providers.
- Pharmacies.
- Medical schemes and administrators.
- Claims processors.
- Cloud hosting providers.
- Technical support providers.
- Regulatory authorities where required by law.
All authorised operators and third parties are expected to maintain appropriate confidentiality and security standards.

JSK Healthcare implements reasonable technical and organisational security safeguards, including:
- Secure authentication.
- OTP verification.
- Role-based access.
- Encryption of data in transit.
- Secure hosting.
- Audit logging.
- Regular backups.
- Disaster recovery procedures.
- Security monitoring.
- Access controls.
- Confidentiality obligations for authorised personnel.
18. Cross-Border Processing
Where necessary for service delivery, technical support, cloud hosting, backup, cybersecurity, or business continuity, information may be processed or stored outside South Africa, subject to appropriate contractual, confidentiality, privacy, and security safeguards.

All intellectual property rights in the Application, including software, source code, databases, trademarks, logos, designs, documentation, graphics, and content, belong to JSK Healthcare or its licensors.
Users may not copy, reproduce, modify, reverse engineer, distribute, or exploit any part of the Application without prior written consent.

JSK Healthcare may suspend or terminate user access where:

- Unauthorised access resulting from compromised user devices or credentials.
- Failures of third-party networks, cloud providers, payment providers, healthcare providers, medical schemes, or telecommunications services.
- Service interruptions caused by maintenance, cyberattacks, force majeure events, infrastructure failures, or events beyond JSK Healthcare's reasonable control, provided reasonable safeguards have been implemented.
22. User Indemnity
Users agree to indemnify JSK Healthcare against claims, losses, damages, or costs arising from:
- False or misleading information provided by the user.
- Misuse of the Application.
- Unauthorised disclosure of confidential information.
- Breach of these Terms.
- Unlawful activities carried out through the user's account.
23. Record Retention
Personal and health information will be retained for the period required by applicable legislation, healthcare recordkeeping requirements, contractual obligations, audit purposes, claims processing, and continuity of care.
Where lawful and appropriate, information may be deleted, destroyed, de-identified, or anonymised after the applicable retention period.

JSK Healthcare may update the Application to:

- Enhance functionality.
- Correct defects.
- Comply with legal or regulatory requirements.

Users are encouraged to install updates promptly.
